1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Auto MM ("Auto MM," "we," "us," or "our"), governing your access to and use of the Auto MM platform, website, and all related services (collectively, the "Service").
By accessing, registering for, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must immediately discontinue use of the Service.
Important: These Terms include provisions that affect your legal rights, including a limitation of liability clause, a dispute resolution process, and a binding arbitration clause. Please read each section carefully.
2. Eligibility
To use Auto MM, you must meet all of the following requirements:
- You must be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater.
- You must have the legal capacity to enter into binding contracts in your jurisdiction.
- You must not be a resident of any country subject to trade sanctions or embargoes that would prohibit your use of the Service.
- You must not have been previously suspended, banned, or otherwise removed from Auto MM for violations of these Terms.
- Your use of the Service must not violate any applicable local, national, or international law or regulation.
We reserve the right to verify eligibility at any time and to suspend or terminate accounts that do not meet these requirements, with or without prior notice.
3. User Accounts
Account Registration
To access certain features of the Service, you must create an account. When registering, you agree to provide accurate, current, and complete information and to keep this information updated. You are responsible for maintaining the confidentiality of your account credentials.
Account Security
You are solely responsible for all activity that occurs under your account. If you become aware of any unauthorized use or security breach, you must notify us immediately at security@auto-mm.com. Auto MM will not be liable for any loss or damage arising from unauthorized account access due to your failure to safeguard your credentials.
Account Restrictions
- You may not create more than one active account without explicit written permission from Auto MM.
- You may not sell, transfer, or assign your account to another person.
- You may not use another person's account without their explicit authorization.
- You may not create an account using a false identity or misrepresent your identity in any way.
4. Middleman Services
Role of Middlemen
Auto MM provides a platform for certified middlemen to facilitate peer-to-peer exchanges of digital goods, game items, accounts, and other agreed-upon assets. Middlemen act as neutral third parties and do not take ownership of items during a transaction. They verify, confirm, and coordinate the exchange between parties.
Middleman Certification
All middlemen on Auto MM are manually vetted by our administrative team. Certification does not guarantee the outcome of any specific transaction, nor does it constitute an endorsement by Auto MM of any individual middleman's actions beyond their verified status at the time of certification.
Middleman Liability
Individual middlemen operate independently on the platform. Auto MM is not a party to any transaction facilitated by a middleman and accepts no liability for the actions or omissions of any middleman. Disputes involving middleman conduct should be directed to our support team via the dispute resolution process described in Section 7.
⚠ Never send items or payments outside of Auto MM's ticketing system. Auto MM cannot mediate or investigate transactions conducted off-platform.
5. Code of Conduct
All users of Auto MM are expected to maintain a standard of conduct befitting a trusted trading community. The following behaviors are strictly prohibited and may result in immediate account suspension or permanent ban:
- Fraud, scamming, or any attempt to deceive another user or middleman.
- Harassment, threats, or abusive communication directed at any user, middleman, or staff member.
- Chargebacks or payment reversals after a transaction has been completed and verified.
- Impersonation of any Auto MM staff member, middleman, or other user.
- Submitting false or misleading reputation feedback.
- Attempting to conduct transactions off-platform to avoid fees or oversight.
- Exploiting platform bugs or vulnerabilities. Any discovered vulnerabilities must be reported to security@auto-mm.com.
- Trading prohibited items, including but not limited to: stolen goods, items obtained through exploits, or items associated with hacked or illegitimate accounts.
6. Fees & Payments
Platform Fees
Auto MM may charge a platform fee for transactions facilitated through the Service. Current fee structures are displayed on the Pricing page and may be updated with 14 days' notice. Middlemen may also charge their own service fees, which are separate from and in addition to platform fees.
Fee Acknowledgment
By initiating a transaction on Auto MM, you acknowledge and agree to the applicable fees at the time of the transaction. Fees are non-refundable except in cases of verified platform error, at our sole discretion.
Payment Responsibility
You are solely responsible for ensuring that payments are made correctly and to the right parties. Auto MM does not process or hold payments directly and accepts no liability for payment errors made by users.
7. Dispute Resolution
Internal Resolution
In the event of a dispute between users, or between a user and a middleman, Auto MM's support team will review available evidence, including ticket chat logs, transaction records, and reputation history. We will make a determination based on the evidence provided and our reasonable interpretation of the facts.
Our dispute resolution process typically takes 3–7 business days. Decisions made by Auto MM's dispute resolution team are final within the scope of the platform and do not constitute legal rulings.
Escalation
If you believe Auto MM's dispute resolution was conducted in bad faith or violated these Terms, you may escalate your concern to our senior review team at disputes@auto-mm.com. Senior review decisions are final.
Binding Arbitration
Any dispute that cannot be resolved through our internal process and involves a claim for financial compensation exceeding $250 USD shall be submitted to binding arbitration under the rules of a mutually agreed arbitration body. Class action claims are expressly waived.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Auto MM, its officers, directors, employees, partners, agents, suppliers, and affiliates shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, goodwill, or other intangible losses.
- Damages resulting from unauthorized access to or alteration of your transmissions or data.
- Damages resulting from the actions or omissions of any middleman or third party on the platform.
- Damages resulting from any transaction or exchange facilitated through the Service.
Auto MM's total aggregate liability in respect of any claims under these Terms shall not exceed the greater of (a) the fees paid by you to Auto MM in the 3 months preceding the claim, or (b) $50 USD.
9. Refund Policy
Given the nature of peer-to-peer digital asset exchanges, Auto MM does not offer refunds on completed transactions. Once a ticket is marked as complete by a middleman and confirmed by both parties, the transaction is considered final.
Exceptions
- Platform fees may be refunded if a transaction is cancelled before any assets are moved, at our sole discretion.
- If a verified platform error caused a transaction to fail or assets to be lost, we will conduct an investigation and may issue a platform credit or refund as appropriate.
- Fraudulent transactions reported within 72 hours and supported by verifiable evidence may be eligible for mediated resolution.
Note: Auto MM does not guarantee asset recovery in the event of fraud. We strongly advise all users to verify the reputation history of all parties before initiating a transaction.
10. Termination
Auto MM reserves the right to suspend, restrict, or permanently terminate any account at any time for any reason, including but not limited to: violation of these Terms, suspicious activity, or at the request of law enforcement authorities.
You may terminate your account at any time by contacting support@auto-mm.com. Upon termination, your right to use the Service ceases immediately. Certain provisions of these Terms shall survive termination, including but not limited to: limitation of liability, dispute resolution, and intellectual property provisions.
Auto MM shall not be liable to you or any third party for termination of your account or access to the Service.
